Online and In-Studio Class Waiver

Parents/Guardians,

We are moving to an online platform for our classes while the studio is closed.  In order to participate in our online classes, please fill out the newly updated waiver to include both online and in-studio classes. The revised Release of Liability is written below and is also available as a printable PDF download. Please fill in and submit the form on this page to participate.

Dance Connections, Inc. Release of Liability

For good and valuable consideration, the undersigned on behalf of the minor child named above, himself/herself, their heirs, assigns, personal representatives and estate (“collectively and individually referred to herein as “Student”) with the intention of binding themselves, their heirs, executors, administrator and assigns, and with the intention of binding the minor children of the undersigned, do hereby expressly release, discharge, indemnify and hold harmless Dance Connections, Inc., its employees, stockholders, officers, agents, directors and every other person acting in any capacity on its behalf, and the heirs, assigns, successors, and agents thereof (collectively “Dance Connections”), from all liability, claims, demands, actions, judgments and matters which the undersigned parties or the Student ever had, now have, or claim to have against Dance Connections, created by or arising out of any activity or matter whatsoever related to Dance Connections or the dance classes, including all in studio and online classes, rehearsals or performances offered or organized by Dance Connections. I understand and acknowledge that dance classes and performances organized and offered by Dance Connections bring with it known, unknown and unanticipated risks to the Student. Those risks include, but are not limited to: falling, slipping, incorrectly performing dance moves, or improper technique, colliding with another student or object, and could result in injury, paralysis, illness, emotional distress, death, and/or property damage. I waive the right of Student to bring any legal action against Dance Connections for any type of injury whatsoever or death sustained on studio property at Dance Connections, 8001 Hillsborough Road, Suite A, B, C, Ellicott City, MD 21043, based upon any participation or use by the Student of any of the online dance classes, or at any Dance Connections event. I expressly agree and promise to accept and assume all of the risks, known and unknown, connected with Dance Connections and its related activities, regardless of the age of the Student and/or whether or not the Student is presumed to be able to assume those risks. I understand that I am enrolling the Student in a program of physical activity and have agreed that the Student is in good physical condition and does not suffer from any condition that would prevent or limit participation in this dance program prior to signing this form. I also understand if I choose, or if I allow the Student, to participate in any online dance classes, including live classes and prerecorded classes, the Student is doing so at their own risk. There will be no supervision by Dance Connections during such classes and Dance Connections shall not be liable, under any circumstance or in any way, including but not limited to, for the failure of Student to use proper technique or to provide a safe area for such online classes. The undersigned agree to reimburse any reasonable attorney's fees, expert witness fees and costs which may be incurred by Dance Connections in the defense of any such liability, claim, demand, action or right of action. I acknowledge and certify that I have had a sufficient opportunity to read this entire document, that I have, in fact, read it in its entirety, that I understand its content and that I execute it freely, intelligently and without duress of any kind. This release shall be legally binding upon execution of this form. You are urged to consult legal counsel to understand the claims and rights that Student is releasing hereunder. If any portion of this release is found void or unenforceable, the remaining portions shall remain in full force and effect.

I hereby give Dance Connections and its affiliates the unrestricted right and permission to copyright and re-use, publish, and republish videos, photographic portraits and pictures of the Student or videos or pictures in which the Student may be included, in whole or in part, separately or in conjunction with other photographs or videos, in any medium now or hereafter known, and for any purpose whatsoever, including but not limited to illustration, art, promotion, or advertising.

This release shall be governed, enforced, performed and construed in accordance with the laws of the State of Maryland, without reference to principles of conflicts of law. If any dispute or controversy arises among the parties concerning any provision contained herein or the relationship between the parties, the parties hereby agree to the exclusive jurisdiction of the courts located in Howard County, Maryland (or if jurisdiction exists, in the United States District Court for the District of Maryland, Northern Division). THE PARTIES HEREBY AGREE TO AND DO WAIVE A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM BROUGHT BY EITHER OF THE PARTIES HERETO AGAINST THE OTHER PARTY ARISING OUT OF THIS RELEASE OR THE RELATIONSHIP BETWEEN THE PARTIES.
